Guy has been with the firm since 1988. He obtained an MA degree in Natural Sciences from Cambridge University, following which he studied law. From 1983 to 1986 he trained in the Intellectual Property Department of the leading city firm, Herbert Smith. Then from 1986 to 1988 he was an assistant solicitor at Heald Nickinson. He has been a partner in Carter-Ruck for 12 years.

Guy specialises in intellectual property law, particularly in its application in the media field. He has substantial experience in dealing with copyright, trade mark, breach of confidence and other intellectual property issues for clients in all areas of the media.

Guy's experience includes:

  • For Kent Messenger Newspapers Guy has acted in numerous copyright, trademark and passing off cases, including obtaining Summary Judgment for an injunction and costs in a copyright infringement action against a rival publisher which has "lifted" advertisements appearing in the classified advertising section of the newspaper. Also obtained Summary Judgment for an injunction and costs in respect of a threatended infringement of Kent Messenger's registered trademark.

  • Guy has acted in numerous intellectual property matters including on behalf of Pearson Education Limited successfully opposing in the UK Trade Marks Registry an application by a rival publisher to register "HOMEWORK HELPERS" as a registered trade mark. Also successfully obtained undertakings from another publisher to cease infringing Pearson Education Limited's trademark "Roget".

  • On two occasions successfully obtaining immediate without notice (ex-parte) injunctions against former Royal servants who had threatened to "sell their story" to tabloid newspapers.

  • On behalf of another prominent client Guy obtained injunctions to restrain a former bodyguard from publishing confidential information in a threatened book.

  • Guy has also acted in numerous libel actions including recently for Sir Terence Matthews (owner of the Celtic Manor Resort in Wales which is the venue for the 2010 Ryder Cup) against the Sunday Mail; obtaining substantial damages plus costs, apology, Statement in Open Court and an undertaking.

  • Guy also acted for Bill Davies (former owner of Aintree Racecourse) in a libel action against the Liverpool Echo, successfully obtaining substantial damages, costs and a Statement in Open Court.

  • Defended Cornell University in libel proceedings brought by Physicist Dr Laurence Godfrey in an action that raised fundamental issues concerning the liability of service providers and other intermediaries for material on the internet.

  • Extensive advisory work to publisher clients on copyright, trade mark and passing off rights in, for example, articles, book and newspaper titles, design and packaging.

  • Advising clients in a wide range of other fields including architecture, product and furniture design and photography, on all aspects of intellectual property law.

  • Acting for numerous publishers and authors drafting, negotiating and advising on contribution, commissioning, film option, film assignment and other publishing agreements.

  • Spearheading international efforts by Saudi Arabian businessman Yassin Kadi to overturn freezing orders made in the aftermath of September the 11th, including obtaining permission from the High Court to pursue Judicial Review proceedings, launching proceedings before the Court of First Instance of the European Court of Justice in Luxembourg, and (through US agents) administrative proceedings before the Office of Foreign Assets Control, in the US Treasury, Washington, DC.

Guy lectures regularly on media and intellectual property matters. He has contributed a chapter on Jurisdiction and Dispute Resolution to the Sweet & Maxwell publication "International Protection of Intellectual Property". He is a regular delegate to the International Copyright Conference of ALAI and a member of the British Literary and Artistic Copyright Association.
